Magistrate Court of Dekalb County

The Magistrate Court of Dekalb County was created in 1983 and handles civil, criminal, and ordinance issues in DeKalb County, Georgia. DeKalb County Magistrate Court is a county court that is called the “people’s court.”

Civil Matters

Civil Court handles legal disputes that are not crimes and cases brought by a plaintiff (person, group, business, institution, or government body) against a defendant (person, group, business, institution, or government body).

Criminal Matters

The Criminal Court handles cases brought by the government against a defendant. These are: arrest warrants, search warrants, and first appearance/bond hearings.

Ordinance Matters

The Magistrate Court of DeKalb County Ordinance Division began handling DeKalb County Code of Ordinance violations on July 1, 2015.

The following offenses require a court appearance, and cannot be paid in advance of court:

  • Loitering for sex
  • Loitering for drugs
  • Disorderly conduct
  • Public indecency
  • Exposure of genitals
  • Reckless operation of a motor vehicle in parking lot or walkway
  • Creating a hazardous or offensive condition

Animal Control

  • Neglect of animal
  • Animal cruelty
  • Dangerous animal
  • Hazardous animal to be constrained or confined
  • Animal abandonment
  • Quarantine of biting dogs and cats
