A semi-truck driver was left dangling over the side of a Louisville, Kentucky bridge after being in a multi-vehicle accident. During a press conference the next day, Louisville Mayor Craig Greenberg said the driver was successfully rescued and unharmed. The unusual and dramatic event serves as a reminder that anyone’s life can be put at risk by negligent drivers. If you or a loved one have been injured in an Atlanta truck accident, you could incur significant losses. The legal team at The Weinstein Firm is ready to help you recover them.

What happened in Kentucky?

The March 1 accident began with a driver hitting a stalled vehicle on the Roger Clark Memorial Bridge. Witnesses report that the motorist struck a car in the right lane around noon. The driver then lost control of the automobile and crossed into oncoming traffic to hit the semi-truck. The bridge where this happened connects Louisville with Southern Indiana and runs over the Ohio River.

The crash caused the semi-truck to plow through the bridge’s safety guardrail and hang precariously above the Ohio River. The driver, unable to escape the truck’s cab, was left hanging for approximately 40 minutes. In a dramatic rescue, a firefighter was lowered from a ladder truck to the driver’s side of the rig. He was then able to reach the driver and lift her to safety. Although the near-death experience was harrowing, Mayor Greenberg noted the driver’s bravery in enduring the ordeal.

The truck driver in the Kentucky crash was reported as being unhurt. Not everyone involved in the incident was so fortunate, however. Two people inside the other vehicles were transported to a local hospital with life-threatening injuries. Officials also noted that despite the guardrail failure, the structural integrity of the bridge was not compromised. It was reopened the next day.

Was negligence involved?

Everyone who drives owes a legal duty to the motorists, bicyclists, and pedestrians around them. Careless driving that breaches this duty can cost lives or cause unnecessary injury to surviving victims. As the investigation unfolds in the Kentucky case, it will need to be determined if negligent conduct played a role. Based on what has been reported, these are some possible examples of such negligence:

The stalled vehicle. Perhaps one of the most obvious questions to ask is why the stalled vehicle was unable to move. Was the driver somehow at fault for traveling in an unsafe vehicle? After the vehicle stalled, did the driver call for assistance or display the hazard lights? Could a manufacturing defect or faulty repair work be responsible?

The first wrecked vehicle. Was the driver who struck the stalled vehicle paying attention or was he or she distracted? Was this individual speeding, driving recklessly, or making unsafe lane changes? Did the driver take reasonable steps (under the circumstances) to try to avoid crossing lanes or to at least stop? Were steps taken to avoid hitting the truck?

The truck driver. The rescue of the truck driver was a positive end to this story. However, it’s unclear if she was partially liable for the accident. Others who were injured may have been hit by the large truck because of the driver’s negligence. Even if the first drivers involved were negligent, the truck driver may also have been. It remains to be seen what, if anything, an investigation may reveal.

Although the semi-truck driver was not hurt, she could have very well been killed or significantly injured. It’s worth asking why exactly the guardrail failed and nearly cost the life of the driver. Could the guardrail have been improperly installed or maintained? Was a private contractor or government agency responsible for its failure?
